根據憲法,工會是職工自願結合的工人階級的群衆組織。爲保障工會在國家政治、經濟和社會生活中的地位,確定工會的權利與義務,發揮工會在社會主義現代化建設事業中的作用,工會組織代表職工的利益,依法維護職工的合法權益。在中國境內的企業、事業單位、機關中以工資收入爲主要生活來源的體力勞動者和腦力勞動者,不分民族、種族、性別、職業、宗教信仰、教育程度,都有依法參加和組織工會的權利。任何組織和個人不得阻撓和限制,國家保護工會的合法權益不受侵犯。

Manual and mental workers in enterprises, institutions, state organs in Chinese to wage income as the main source of living regardless of nationality, race, sex, occupation, religious belief and education, have the right to participate in and organize trade unions in accordance with the law. No organization or individual shall obstruct or restrict. The State shall protect the lawful rights and interests of the trade union.
